State Claims Agency

The management of certain categories of personal injury claims (injuries alleged to have occurred within Ireland) against the Department had been delegated to the State Claims Agency (SCA) since 1st September, 2005. The management of the remaining categories of personal injury claims (accidents overseas, PTSD, bullying and other harassment cases that had been managed by the Chief State Solicitor’s Office) was delegated to the SCA in November 2011.

Chief State Solicitor’s Office (CSSO)

All employment based claims against the Minister are managed by the Chief State Solicitor’s Office to include

• Judicial Reviews
• Claims made by State employees arising for alleged breaches of the Employment Equality Act, 1998
• Defamation claims

The Injuries Board

Under the PIAB Act 2003 all claims for personal injury (excluding medical negligence) must now be submitted to PIAB.

The Injuries Board is a statutory body which provides independent assessment of personal injury compensation for victims of Workplace, Motor and Public Liability accidents. This assessment is provided without the need for the majority of current litigation costs, such as Solicitors, Barristers and Experts fees, associated with such claims.
